Dispute Over Cumis Counsel Fees Defeats Bad Faith, Breach Claims, Judge Rules

SACRAMENTO, Calif. - The plaintiffs in a dispute over defense fees under a professional liability insurance policy failed to establish that they were due all the claimed amounts or that they suffered damages from their insurers' denial of payments, a California federal judge ruled Nov. 12, issuing judgment in the insurers' favor (Dale M. Wallis, D.V.M., et al. v. Centennial Insurance Company Inc., et al., No. 2::08-cv-02558, E.D. Calif.; 2013 U.S. Dist. LEXIS 161304).
