Expect Continuing Inconsistency After Howell V. Hamilton

Application of the California Supreme Court’s landmark ruling in Howell v. Hamilton Meats & Provisions Inc. has resulted in inconsistent verdicts, depending primarily on whether a plaintiff is insured. Unfortunately, until Howell's issues are addressed, either by the California State Legislature or Supreme Court, the case will continue to result in inconsistent verdicts that may not reflect the true measure of a plaintiff’s damages, says Michael Alder of Alderlaw PC.
