Division One of the Court of Appeals filed 3 new published opinions on Monday, November 25, 2013:
1. Lane v. Port of Seattle
(November 25, 2013)
2013 Wash. App. LEXIS 2704
Areas: GOVERNMENT RELATIONS AND ADMINISTRATIVE LAW
PROPERTY AND LAND USE LAW
Brief: The Port of Seattle acted within its statutory powers when it purchased the Eastside Rail Corridor from Burlington Northern Santa Fe Railway Company for $81.4 million and sold portions to King County and the City of Redmond.
2. In re Marriage of Larson
2013 Wash. App. LEXIS 2703
Areas: DOMESTIC RELATIONS AND FAMILY LAW
Brief: A trial court's authority to award one spouse's separate property to the other spouse in a dissolution action is not limited to circumstances where a spouse cannot be amply provided for from community property alone. RCW 26.09.080 does not single out the property's character or any other factor to be given more weight. This statute and controlling case authority direct the trial court to make a fair and equitable property division after weighing all relevant factors within the context of the parties' specific circumstances.
3. State v. Williams
2013 Wash. App. LEXIS 2702
Areas: CRIMINAL LAW
Brief: The Court of Appeals affirms the judgment and sentence imposed following the defendant’s convictions for attempting to elude a pursuing police vehicle and first degree driving with a suspended license, rejecting his arguments that defects in the information and special verdict instructions regarding the sentencing enhancement of endangering the public pursuant to RCW 9.94A.834 mandate reversal.
