Judge: Nebraska Law Governs Suit Challenging Coverage For Defective Product Action

FORT LAUDERDALE, Fla. - Under the principle of lex loci contractus, Nebraska law governs a commercial general liability insurer's lawsuit seeking a declaration as to coverage for an underlying defective product lawsuit against its dietary supplement manufacturer insured, a Florida federal judge ruled March 8 (James River Insurance Company v. Fortress Systems LLC, et al., No. 11-60558, S.D. Fla.; 2012 U.S. Dist. LEXIS 30690).
