Single Deductible Applies For All Claims Arising Out Of 1 Occurrence, Panel Says

ATLANTA - Because the plain and ordinary meaning of an insurer's policy endorsement, as well as the intent of the parties, supports a construction of the policy that imposes a single deductible for all claims flowing from a single design defect occurrence, the 11th Circuit U.S. Court of Appeals on March 21 affirmed a summary judgment ruling in favor of the insured (United States Stove Co. v. Steadfast Insurance Co., No. 10-14983, 11th Cir.; 2012 U.S. App. LEXIS 5868).
