Patent Declaratory Judgment Case Wrongly Dismissed, Federal Circuit Says

WASHINGTON, D.C. - A Michigan federal judge improperly found subject matter jurisdiction lacking in a declaratory judgment patent action, the Federal Circuit U.S. Court of Appeals ruled March 26 in a dispute over retroflective sheeting technology (3M Company v. Avery Dennison Corp., No. 11-1339, Fed. Cir.; 2012 U.S. App. LEXIS 6172).
