Health Insurer Granted Judgment; Policy Excludes Pre-existing Conditions

PHOENIX - An Arizona federal judge on March 26 granted a health insurance company's summary judgment motion in a wrongful rescission of health care coverage suit, saying that the policy at issue excluded coverage for pre-existing conditions and that the plaintiff had a pre-existing condition when he applied for the cancer insurance (Michael Loza v. American Heritage Life Insurance Co., No. 09-1118, D. Ariz.; 2012 U.S. Dist. LEXIS 40438).
