Insurance Agent Did Not Act On Behalf Of Insureds, Tennessee High Court Rules

KNOXVILLE, Nash. - An insurance agent's transfer of a van to a personal policy, which insureds denied they requested, was not subject to ratification by the insureds because the agent was not acting on their behalf when it made the alleged transfer, a majority of the Tennessee Supreme Court affirmed March 26, holding that an insurer is estopped from denying coverage under a commercial policy (Allstate Insurance Co. v. Diana L. Tarrant, et al., No. 0810463, Tenn. Sup.; 2012 Tenn. App. LEXIS 194).
