Class Certification Denied In Suit Over Lack Of Seats For CVS Cashiers

SAN DIEGO - The question of whether CVS Pharmacy violates state labor laws by not providing seats for cashiers does not have a common answer for a proposed class of more than 17,000 cashiers at CVS stores in California, a federal judge in that state held April 4 in denying class certification in a former cashier's lawsuit against the company (Nykeya Kilby v. CVS Pharmacy, Inc.,  No. 09-cv-2051, S.D. Calif.; 2012 U.S. Dist. LEXIS 47855).
