2nd Circuit Affirms Ruling Against Insurer In Trust Mismanagement Coverage Dispute

NEW YORK - The Second Circuit U.S. Court of Appeals on May 17 affirmed a lower federal court's ruling that a professional liability insurer has a duty to defend its insured against underlying allegations that the insured grossly mismanaged the New York Healthcare Facilities Workers' Compensation Trust (Westport Insurance Corp. v. Hamilton Wharton Group Inc., et al.,  Nos. 11-1153-cv and 11-1493-cv, 2nd Cir.; 2012 U.S. App. LEXIS 9888).
