D.C. Circuit Court Upholds Dismissal Of Negligence Suit Against Bank, Servicer

WASHINGTON, D.C. - A federal judge in the District of Columbia properly dismissed a man's negligence lawsuit against Bank of America N.A. and its loan-servicing arm after finding that the plaintiff could not pursue tort liability against the defendants based on their handling of his request for a loan modification, a panel of the District of Columbia Circuit U.S. Court of Appeals ruled May 22 (Lymar Curry v. Bank of America Home Loans Servicing LP, et al., No. 11-7095, D.C. Cir..; 2012 U.S. App. LEXIS 10310).
