Judge Finds Defendants' State Law Counterclaims Preempted By CERCLA

MILWAUKEE - The Comprehensive Environmental Response, Comprehensive Environmental Response Compensation and Liability Act (CERCLA), 42 U.S.C.S. § 9601,  preempts state law counterclaims raised by defendants seeking contribution toward cleanup efforts at the Lower Fox River Superfund site, a federal judge in Wisconsin ruled Oct. 4 (Appleton Papers Inc., et al. v. George A. Whiting Paper Co., et al., No. 08-C-16, E.D. Wis.; 2012 U.S. Dist. LEXIS 143798).
