Magistrate Judge Says Plaintiffs Can Be Added To Suit Over Contamination

NEWARK, N.J. - The sole principals to a realty company suing Chevron U.S.A. Inc. over a gasoline leak that contaminated groundwater and soil at a property can be added as plaintiffs to its breach of contract and negligence suit, a federal magistrate judge in New Jersey ruled Dec. 28, finding that the amendment was not futile and that the defendant company would not be prejudiced by the addition (Dattilo Realty v. Chevron U.S.A. Inc., et al., No. 09-2278, D. N.J.; 2012 U.S. Dist. LEXIS 182575).
