U.S. Supreme Court Denies Certiorari In Denial Of Medicare Coverage Case

WASHINGTON, D.C. - The U.S. Supreme Court on Jan. 7 denied a petition for writ of certiorari sought by the trustee for the bankruptcy estate of a durable medical equipment manufacturer, leaving in place a lower court decision finding that coverage denials for the equipment were not arbitrary and capricious under Medicare (Monique D. Almy, Chapter 7 Trustee for the bankruptcy estate of BioniCare Medical Technologies Inc. v. Kathleen Sebelius, Secretary of Health and Human Services, No. 12-356, U.S. Sup.).
