Insurer Has No Further Duty To Defend, Indemnify, Federal Magistrate Judge Says

PORTLAND, Ore. - Assuming an insurer paid $6 million in indemnity payments to its insured for environmental contamination claims, the insurer exhausted its policy limits and has no further duty to defend or indemnify the insured, an Oregon federal magistrate judge said Feb. 4 (Siltronic Corp. v. Employers Insurance Company of Wausau, et al., No. 11-1493, D. Ore.; 2013 U.S. Dist. LEXIS 14442).
