Judge: Insurer's Conduct 'Inequitable' And 'Arguments Approach Frivolousness'

GREENVILLE, S.C. - Former bank directors timely notified a directors and officers liability insurer of an underlying breach of fiduciary and negligence lawsuit prior to the expiration of the policy's extended reporting period, a North Carolina federal judge ruled Feb. 5 (W. Edward Anderson, et al. v. The Cincinnati Insurance Co., et al., No. 1:12-156-HMH, W.D. N.C.; 2013 U.S. Dist. LEXIS 15366).
