2nd Circuit Ruling May Force FDA's Hand In Banning Antibacterial Soap Chemical

NEW YORK - An environmental advocacy group has standing to sue the Food and Drug Administration to force it to finalize a drug monograph that may ban one ingredient in antibacterial soaps, but its lacks standing as to another antibacterial, a federal appeals court panel ruled March 15 in reversing summary judgment for the federal government (Natural Resources Defense Council, Inc. v. United States Food and Drug Administration, et al., No. 11-422, 2nd Cir.).
