Panel Vacates Judgment To Insurance Broker On Claims Of Negligence, Fiduciary Duty

ATLANTA - The 11th Circuit U.S. Court of Appeals on April 16 vacated a grant of summary judgment in favor of an insurance broker on an insured's claims for negligence and breach of fiduciary duty and remanded for reconsideration in light of the Florida Supreme Court's ruling on the application of the economic loss doctrine (Tiara Condominium Association Inc. v. Marsh & McLennan Companies Inc., et al., No. 09-11718, 11th Cir.; 2013 U.S. App. LEXIS 7583).
