BOSTON - A First Circuit U.S. Court of Appeals panel on May 21 vacated the dismissal of a woman's claim that Wells Fargo Bank N.A. breached the terms of a trial payment plan (TPP) by failing to offer her a permanent loan modification after making the three payments required by the agreement, ruling that her allegations were adequate to survive a motion to dismiss under Federal Rule of Civil Procedure 12(b)(6) (Susan K. Young v. Wells Fargo Bank, N.A., et al., No. 12-1405, 1st Cir.; 2013 U.S. App. LEXIS 10189).
