Washington Federal Judge Grants Summary Judgment On Copyright Claims

SPOKANE, Wash. - A copyright infringement defendant's unrefuted, sworn testimony that his accused house design was independently created several years before the creation of a plaintiff's copyrighted plan is sufficient to support summary judgment, a Washington federal judge ruled June 21 (Lexar Homes LLC v. Jon Port et al., No. 12-416, E.D. Wash.).
