Judge Rejects Interlocutory Appeal In Case Seeking Preemption Of Asbestos Claims

BATON ROUGE, La. - A federal judge on July 8 denied a motion seeking interlocutory review, finding Louisiana law "clear" that the Longshore Harbor Workers' Compensation Act (LHWCA) did not preempt claims alleging exposure to asbestos prior to 1972 (Robert Legendre, et al. v. Anco Insulations Inc., et al., No. 12-94, M.D. La.; 2013 U.S. Dist. LEXIS 85620).
