NEW YORK - A man's original testimony in an asbestos exposure case fails to assert liability on an electric product supplier, and an affidavit submitted in opposition to summary judgment may not be relied upon to raise triable issues of material fact, a New York justice held in an opinion posted July 9 (Stanley Friedman and Phyllis Friedman v. A.O. Smith Corp., et al., No. 190187/12, N.Y. Sup., New York Co.).
