N.J. Insurance Guaranty Has Duty To Pay Insured's Damages After Offset, Panel Finds

TRENTON, N.J. - Workers' compensation insurance and other payments should be offset only against an insured's total damages in calculating the New Jersey Property-Liability Insurance Guaranty Association's (NJPLIGA) obligation to pay on behalf of an insolvent insurer, the New Jersey Superior Appellate Division affirmed July 15 (George Oyola and Audrey Oyola v. Xing Lan Liu, et al., No. A-1107-12T3, N.J. Super., App. Div.; 2013 N.J. Super. LEXIS 108).
