Federal Circuit Reverses, Vacates Lost Profits Award In Patent Case

WASHINGTON, D.C. - Although a California federal judge correctly set aside a jury verdict of willful patent infringement, he erred in awarding lost profits damages to a prevailing plaintiff, the Federal Circuit U.S. Court of Appeals ruled July 18 (Calico Brand Inc. v. Ameritek Imports Inc., No. 08-1324, Fed. Cir.).
