Judge Finds Claim For Violations Of Insurance Code Cannot Support Bad Faith Claim

KANSAS CITY, Kan. - A Kansas federal judge on July 25 held that a policyholder's bad faith claim based on assertions that its insurer violated Kansas insurance regulations failed because state law does not create a private right of action for such claims, leading the judge to partly grant the insurer's motion for dismissal (H&L Associates of Kansas City LLC v. The Midwestern Indemnity Co., No. 2:12-cv-02713, D. Kan.; 2013 U.S. Dist. LEXIS 104124).
