Debt Collector Violated Statute, Federal Judge Rules

SAN DIEGO - A debt collector violated the Fair Debt Collection Practices Act (FDCPA) by not identifying an original creditor in a form complaint, a federal judge in California ruled Aug. 13, awarding summary judgment to a consumer who sued the debt collector (Maria Caudillo v. Portfolio Recovery Associates LLC, No. 12-0200, S.D. Calif.; 2013 U.S. Dist. LEXIS 114305).
