7th Circuit Affirms Ruling Against Insurer In Employers Liability Coverage Dispute

CHICAGO - The Seventh Circuit U.S. Court of Appeals on Aug. 21 affirmed a lower federal court's finding that an insurance policy term for "employers' liability laws" encompasses any claim in which an employee or the employee's dependent seeks to impose liability on the insured employer for a workplace injury or disease even if the claim is based on statutory or common law and is "groundless" (TKK USA Inc. f/k/a The Thermos Co. v. Safety National Casualty Corp., No. 12-1988 and 12-2091, 7th Cir.; 2013 U.S. App. LEXIS 17606).
