New York Federal Judge Allows Statute Of Limitations Defense Against Subrogated Insurer

NEW YORK - A New York federal judge on Aug. 27 granted a motion by contractors to amend their answer to interpose the affirmative defense of statute of limitations against a subrogated insurer regarding damages sustained by alleged negligent installation of plumbing joints (Affiliated FM Insurance Co. v. Liberty Mechanical Contractors Inc. d/b/a Liberty Mechanical Inc., et al., No. 12-5160, S.D. N.Y.; 2013 U.S. Dist. LEXIS 122030).
