Gas Lease Dispute Survives Summary Judgment Motions In Northern Ohio Federal Court

YOUNGSTOWN, Ohio - Cross-motions for summary judgment in a natural gas lease declaratory judgment action pending in the U.S. District Court for the Northern District of Ohio were denied Aug. 30 because issues of material fact with respect to the creation of a gas extraction unit without approval of the landowner and the company's duty to pay delay payments after the primary period of the lease require a trial to resolve the dispute, according to the presiding judge (Beaverkettle Farms v. Chesapeake Appalachia, No. 11-2631, N.D. Ohio; 2013 U.S. Dist. LEXIS 124509).
