Unintentional Discrepancy Does Not Violate ATM Fee Statute, Judge Finds

PITTSBURGH - A fee notice on the PNC Bank National Association's ATMs sufficiently informed the plaintiff in an Electronic Fund Transfer Action (EFTA) putative class action that he may be charged a fee, a federal judge in Pennsylvania said Sept. 20, granting the bank's motion for summary judgment and denying class certification (Daniel D. DiCioccio v. PNC Bank National Association, No. 12-289, W.D. Pa.; 2013 U.S. Dist. LEXIS 134458).
