Duty To Defend Suit Filed In West Virginia Dismissed For Lack Of Jurisdiction

BECKLEY, W.Va. - A declaratory judgment lawsuit filed in the U.S. District Court for the Southern District of West Virginia by an insurance company that sold an insurance policy to the owners of a residence that was contaminated by the operation of an illicit drug laboratory was dismissed Sept. 24 for lack of subject matter jurisdiction because the insurance company failed to satisfy the amount in controversy standard (USAA Casualty Insurance Co. v. James R. Elkins III, et uxor, No. 13-10979, S.D. W.Va.; 201 U.S. Dist. LEXIS 136222).
