Judge Denies Dismissal Of Insurer's Coverage Action Regarding Defect Dispute

BECKLEY, W.Va. - A West Virginia federal judge on Sept. 25 refused to dismiss a commercial general liability insurer's declaratory judgment action regarding its duty to defend and indemnify an insured for failure to meet specifications on a construction project (Westfield Insurance Co. v. Carpenter Reclamation Inc., et al., No. 13-12818, S.D. W.Va.; 2013 U.S. Dist. LEXIS 137151).
