NEW YORK - A New York federal judge on Sept. 26 refused to decertify a Fair Labor Standards Act (FLSA) class of store managers (SMs) who allege that they were improperly classified as exempt from overtime wages and partially granted a motion to certify a class of New York SMs for the purposes of liability only (Yatram Indergit, et al. v. Rite Aid Corporation, et al., No. 08-9361, S.D. N.Y.; 2013 U.S. Dist. LEXIS 138614).
