Judge Grants Leave To Insurer To Assert Allegations Regarding Its Duty To Defend

NEWPORT NEWS, Va. - A Virginia federal judge on Oct. 22 granted leave to an insurer to amend its complaint to allege claims against insureds concerning a duty to defend an underlying construction defects lawsuit that would warrant federal jurisdiction (Liberty Mutual Fire Insurance Co. v. KB Home Inc., et al., No. 13-98, E.D. Va.; 2013 U.S. Dist. LEXIS 151737).
