Insolvent Insurer's Breach Of Agreement Claim Is Time-Barred, Judge Finds

WICHITA FALLS, Texas - An insolvent insurer's breach of indemnification agreement is time-barred under the four-year statute of limitations applicable to a general indemnity agreement, a Texas federal judge ruled Oct. 22 (Amwest Surety Insurance Co., in liquidation v. Jose L. Cardenas and Gloria Cardenas, No. 12-00146, N.D. Texas; 2013 U.S. Dist. LEXIS 151335).
