Insurer Has No Duty To Defend Donor's Suit Against School, 1st Circuit Affirms

BOSTON - The First Circuit U.S. Court of Appeals on Oct. 23 affirmed a lower court's ruling that a nonprofit organization directors and officers insurer has no duty to defend or indemnify its school insured against an underlying lawsuit brought by a donor (The Clark School for Creative Learning Inc. v. Philadelphia Indemnity Insurance Co., No. 13-1171, 1st Cir.; 2013 U.S. App. LEXIS 21568).
