5th Circuit Affirms Dismissal Of Foreclosure Suit Based On Res Judicata

NEW ORLEANS - A Fifth Circuit U.S. Court of Appeals panel on Oct. 30 upheld the dismissal of a man's foreclosure lawsuit against U.S. Bank N.A. and Mortgage Electronic Registration Systems Inc. (MERS) after agreeing with a federal judge in Texas that the plaintiff's claims were barred by the doctrine of res judicata (James Hollowman Maxwell v. U.S. Bank, N.A., et al., No. 13-20113, 5th Cir.; 2013 U.S. App. LEXIS 22126).
