Plaintiff's Wrongful Death Tobacco-Related Claims Survive Motion To Dismiss

TAMPA, Fla. - A plaintiff whose decedent is not a member of the Florida tobacco class in Engle v. Liggett Group Inc. (945 So. 2d 1246 [Fla. 2006]) has stated sufficient facts to defeat a motion to dismiss her wrongful death claims, a Florida federal judge said Nov. 8 (Tammie P. Liason, et al. v. Lorillard Tobacco Company, et al., No. 8:13-cv-1115, M.D. Fla.; 2013 U.S. Dist. LEXIS 160097).
