Federal Judge Strikes Unclean Hands Defense In Promissory Note Action

CHICAGO - A federal judge in Illinois on Dec. 13 struck the unclean hands affirmative defenses from a promissory note collection suit filed by FirstMerit Bank N.A., which assumed the note from the failed Midwest Bank and Trust Co., finding that the defense fails as a matter of law (FirstMerit Bank N.A. v. Quanstrom-Rose LLC, et al., No. 12-10051, N.D. Ill.; 2013 U.S. Dist. LEXIS 174447).
