Failure To Properly Calculate Depreciation May Be Breach, Bad Faith, Judge Finds

MUSKOGEE, Okla. - Finding it likely that a homeowners insurer "failed to reasonably calculate depreciation" of a fire-damaged home, an Oklahoma federal judge on Jan. 6 declined to dispose of breach of contract and bad faith claims against the insurer (Manuel Owen v. Farmers Insurance Company Inc., No. 6:12-cv-00384, E.D. Okla.; 2014 U.S. Dist. LEXIS 822).
