Government Awarded Partial Summary Judgment On Clean Air Act Claims

WHEELING, W.Va. - A federal judge in West Virginia on Jan. 14 granted in part a motion for partial summary judgment filed by the federal government in which the government claims that a coal company's emissions from its coke oven combustion stacks violated the Clean Air Act's (CAA) opacity standards (United States of America v. Mountain State Carbon LLC, No. 12-CV-19, N.D. W.Va.; 2014 U.S. Dist. LEXIS 4323).
