Mealey's Personal Injury - Federal Circuit Reverses Awards In 2 DTaP Vaccines Epilepsy Injury Claims

WASHINGTON, D.C. - The Federal Circuit U.S. Court of Appeals on Jan. 28 reversed a vaccine injury compensation award involving two children allegedly injured by diphtheria and tetanus toxoids and acellular pertussis (DTaP) vaccine, saying that a special master properly found that the injuries were more likely than not caused by a gene mutation in each child (Jed Snyder, et al. v. Secretary of Health and Human Services, No. 2013-5068, Frank Harris, et al. v. Secretary of Health and Human Services, No. 2013-5072, Fed. Cir.; 2014 U.S. App. LEXIS 1674).
