Mealey's Litigation Procedure - Judge Dismisses RICO Claims Against Insurance Agents In Alleged Premium Scheme

SAN FRANCISCO - Insureds failed to assert violations of the Racketeer Influenced and Corrupt Organizations (RICO) Act, 18 U.S. Code Sections 1962(c) and (d), against insurance agents and an insurer regarding claims pertaining to force-placed insurance premiums that were charged outside the statute of limitations, a California federal judge ruled Jan. 29 (Stanley D. Cannon, et al. v. Wells Fargo Bank, N.A., et al., No. 12-1376, N.D. Calif.; 2014 U.S. Dist. LEXIS 11163).
