Mealey's Bankruptcy - 10th Circuit: Debtor Lacks Standing To File Damages Claim Against Government

DENVER - A panel of the 10th Circuit U.S. Court of Appeals on March 26 ruled that a debtor lacked standing to bring a damages lawsuit against the U.S. government related to his veteran benefits because only the trustee had standing to bring a lawsuit once the debtor had filed for bankruptcy (Brian S. Willess v. United States of America, No. 13-6159, Chapter 7, 10th Cir.; 2014 U.S. App. LEXIS 5516).
