Mealey's Banking & Finance - 1st Circuit Upholds Dismissal, Denial Of Woman's Request To Amend Foreclosure Suit

BOSTON - A First Circuit U.S. Court of Appeals panel on May 27 upheld a federal judge in Massachusetts' ruling dismissing a woman's lawsuit claiming that the bank that foreclosed on her property lacked authority to do so, ruling that under Massachusetts law, the mortgage note and deed of trust can be separable when transferred between members of the Mortgage Electronic Registration Systems Inc. (MERS) (Rhonda G. Mills v. U.S. Bank, N.A., et al., No. 13-1907, 1st Cir.; 2014 U.S. App. LEXIS 9713).
