Mealey's Litigation Procedure - Judge Refuses To Compel Arbitration, Finds Validity Must Be Decided At Trial

BROOKLYN, N.Y. - After finding that the issue of whether an underlying arbitration agreement is valid must be decided at trial, a New York federal judge on June 13 refused to compel arbitration of a dispute related to the licensing of a frequency band (Les Telecommunications D'Haiti S.A.M. v. Franck Cine, No. 13-CV-6462, E.D. N.Y.; 2014 U.S. Dist. LEXIS 81172).
