SAN DIEGO - A California appellate court on June 27 affirmed a trial judge's ruling granting a developer's motion for demurrer in a lawsuit brought by a proposed class over alleged construction defects to their condominiums, finding that the proposed class had numerous chances to state sufficient claims against the defendant (James Sarnecky, et al. v. Barratt Developments PLC, No. D063848, Calif. App., 4th Dist., Div. 1; 2014 Cal. App. Unpub. LEXIS 4514).
