Situation

“In 2009, we were retained as plaintiff’s counsel in a massive patent litigation matter and we realized the case was going to involve a staggering volume of electronic discovery,” recalled Patti Towers, senior litigation paralegal at Rader Fishman. “We quickly concluded the amount of data that was going to be produced and stored was greater than what our systems could realistically handle.”

According to Towers, the firm explored a variety of options available to them. After conducting some initial research, they decided to look for an outside solution to their daunting litigation data management challenge.

“We started our process by identifying platforms for hosting litigation documents that were capable of handling millions of pages associated with a single matter,” said Towers. “We also knew it would be important to have a system in place that would accommodate real-time access to the documents by attorneys and outside experts. And naturally, we were very concerned about choosing a solution that was backed by a company with a good reputation and a long-term commitment to the legal industry.”

The most amazing benefit of Hosted FYI is the ease with which our lawyers are able to access litigation documents from anywhere in the world, at anytime. It’s incredibly seamless and user-friendly, which makes my job easier and the lawyers more productive.

Solution

The firm’s litigation staff began its research into available offerings in the marketplace that met their selection criteria. They quickly narrowed down the list to two competing solutions.

“After careful review, we all agreed that LexisNexis Hosted FYI was the most precise fit for our specific needs,” said Towers. “It was clear to us that Hosted FYI was developed for situations just like ours—a law firm with the need to partner with an outside provider for comprehensive data management, online review and disaster recovery capabilities.”

Utilizing the award-winning Concordance® FYITM software, Hosted FYI offers a secure, multi-user solution for processing, storing, retrieving, analyzing, reviewing, redacting and sharing discovery documents. The solution is backed by LexisNexis, a company with more than 35 years of experience in legal data management, and enables law firms to control costs, minimize risk and maximize internal resources.

Benefits

The Rader Fishman litigation team has been extremely pleased with the benefits they have achieved from selecting Hosted FYI to host their electronic discovery in the still-developing patent litigation matter. The case recently surpassed 8 million pages of documents that have been archived in the Hosted FYI data repository.

According to Towers, the most noteworthy benefits include:

  • Convenient access to litigation documents
“The most amazing benefit of Hosted FYI is the ease with which our lawyers are able to access litigation documents from anywhere in the world, at any time,” she said. “It’s incredibly seamless and user-friendly, which makes my job easier and the lawyers more productive.”
  • Increase in capacity of the firm’s servers
By shifting the responsibility for hosting and managing all of the e-discovery documents for the entire case to Hosted FYI, Rader Fishman now has plenty of space on its own servers for other cases and the firm’s various day-to-day IT requirements.
  • Improved collaboration between attorneys and outside experts Rader Fishman litigators and the outside experts they retained to work on the case—most of whom work in different geographic areas—can easily access the same data files and efficiently work on projects together in real time. This allows them to collaborate more effectively and more closely, even when they’re unable to work together in the same office.
  • Reduced costs to clients“Another interesting benefit to Hosted FYI is that it ultimately reduces costs for our clients,” explained Towers. “Since our attorneys and experts are able to access documents much faster and easier, they work more efficiently. This enables them to accomplish work for clients in a shorter amount of time, which reduces costs.”
  • Risk management Finally, the firm has a risk management strategy in place that raises the comfort level of the team because its litigation data is all hosted, managed and backed-up by LexisNexis. The proven data recovery capabilities of Hosted FYI reduce the firm’s exposure to business interruptions while the firm is litigating the case.

Hosted FYI has helped our law firm control costs, minimize risk and maximize our internal resources throughout the electronic discovery phase of this case. This platform is a terrific solution for a law firm that is unable or unwilling to commit the substantial resources necessary to manage a huge volume of litigation data associated with a large case.
