Judge Reverses Preemption Ruling In Paxil Suicide Case
INDIANAPOLIS - A federal judge on July 18 reversed a ruling awarding summary judgment to SmithKline Beecham Corp., doing business as GlaxoSmithKline (GSK), in a Paxil suicide case based on federal preemption after reviewing the Food and Drug Administration's regulations on drug labeling and concluding that the company has an obligation to revise a drug's warning when it receives reasonable evidence of an association between the drug and an adverse event (Debra L. Tucker v. SmithKline Beecham Corp., d/b/a GlaxoSmithKline, No. 04-CV-1748-DFH-WTL, S.D. Ind.). From Mealey's Litigation Report: Antidepressant Drugs
