Pennsylvania Judge Rules Claims Against Cell Phone Industry Are Preempted
PHILADELPHIA - Eastern District of Pennsylvania Judge John R. Padova granted a defense motion to dismiss claims against the cell phone industry Tuesday on the grounds that the conspiracy and failure-to-warn claims are preempted by Federal Communication Commission regulations establishing radio frequency (RF) standards for wireless communication (Francis J. Farina, et al. v. Nokia, et al., No. 06-724, E.D. Pa.).
